Role as applicant, chemical data provider or agent

What’s an applicant?

Applicants are people or businesses who apply to us for assessment certificates and commercial evaluation authorisations. They also submit pre-introduction reports. They must complete essential parts of the process, and can nominate other participants such as chemical data providers and agents.

Applicants:

• can initiate any application, such as for an assessment certificate or Inventory-related applications
• must use the approved form for an application
• can make a joint application with another person
• receive an assessment certificate or commercial evaluation authorisation if an application for a certificate or authorisation is successful
• become known as a certificate or authorisation holder if their application is successful
• can introduce a chemical after receiving a certificate or authorisation
• must be registered with AICIS before introducing a chemical
• can cancel or withdraw an application before the Executive Director makes a decision
• need to have an AICIS Business Services account
• must give the Executive Director information relevant to their application if they become aware of it before the Executive Director makes a decision (they can request an extension)
• can apply to be a holder of confidential business information (CBI)
• can nominate a chemical data provider to complete parts of their application
• can initiate and submit CBI applications
• can make a written submission in response to a draft assessment statement
• can request the Executive Director to reconsider a decision
• must keep records if they’re introducing a chemical
• can request the terms of an assessment certificate to be varied if all other certificate holders agree
• can request the terms of an authorisation to be varied
• can nominate an agent to complete parts of the application and correspond with AICIS about an application
• can nominate an agent to create and submit pre-introduction reports (PIR) on their behalf
• can apply to be removed as a certificate or authorisation holder
• can request to cancel a certificate or authorisation if all other certificate or authorisation holders agree
• can act as an agent for another applicant or a chemical data provider

Applicants have rights and obligations. We:

• must give applicants written notice of decisions, including reasons if the decision’s a refusal
• must consult applicants when it’s time for review of the CBI status of their certificate or authorisation
• must consult applicants if we reject the applicant’s request to:
  • cancel an assessment certificate
  • vary the terms of an assessment certificate
  • vary the terms of an authorisation
  • vary an Inventory listing
• can request applicants to provide further information for their application

What’s a chemical data provider?

A chemical data provider is a person or business who submits information as part of another person’s AICIS application or submission. For example, the chemical data provider may provide chemical identity details directly to us (but not to the applicant) because the information is considered to be confidential or commercially sensitive.

Before this can happen, the applicant must nominate the chemical data provider in the relevant online form. We will send an email to the nominated chemical data provider asking them to acknowledge their participation. Once they have acknowledged their role, the chemical data provider can then enter their information into the application or report through AICIS Business Services.

Chemical data providers:

• need to have an AICIS Business Services account
• can act as an agent for an applicant or another chemical data provider
• can provide chemical information in a pre-introduction report
• can provide chemical information as part an application for an assessment certificate
• can provide chemical information in a post-introduction declaration
• can apply for protection of the information they provide as confidential business information (CBI)
• will become a CBI holder if their CBI application is approved
• can’t be an applicant in the same process if they’re already acting as a chemical data provider
• can’t initiate or submit an application on behalf of the applicant
• don’t get an assessment certificate or a commercial evaluation authorisation if an application is successful

What’s an agent?

An agent is a person or business that an applicant or chemical data provider appoints to act on their behalf. Agents can participate in assessment certificate applications, pre-introduction reports and commercial evaluation authorisation applications.

Agents:

• can complete parts of the application and correspond on the application with AICIS
• can’t initiate an application on behalf of an applicant
• can’t apply to be a holder of CBI
• don’t get an assessment certificate or a commercial evaluation authorisation if an application is successful
• don’t become a holder of a certificate, authorisation or CBI
